Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the Awdio mobile application (the “App”) on iOS and Android devices, published by Elevation Interactive LLC (“we”, “us”). By installing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

Description of the App

Awdio is an audiobook player that connects to audiobook libraries you host yourself on Plex Media Server or Audiobookshelf. The App does not provide audiobook content; it provides a player for content you already own or have legitimate access to through your own servers.

Your Server, Your Content, Your Responsibility

The App is a client. You are solely responsible for:

• Operating and securing the Plex Media Server or Audiobookshelf server you connect the App to.
• Ensuring you have the legal right to access, store, and play the audio content in your library.
• Compliance with the terms of service of Plex Inc. and the Audiobookshelf project, as applicable.
• The cost and availability of the network connections used to stream or download content.

Elevation Interactive LLC has no control over the content of your library and accepts no responsibility for it.

Acceptable Use

You agree not to:

• Use the App to access content you do not have the legal right to access.
• Reverse engineer, decompile, or attempt to extract source code from the App, except to the extent permitted by applicable law.
• Use the App to interfere with, disrupt, or place an unreasonable load on third-party services, including Plex servers, Audiobookshelf servers, or crash-reporting services.
• Use the App in any way that violates applicable law.

Premium Features

Awdio may offer premium features in addition to its free functionality. Premium features may include offline downloads, advanced listening statistics, custom themes, and other capabilities introduced over time.

If a premium offering is available, it will be processed entirely through the platform's in-app billing system (Apple App Store on iOS, Google Play on Android). Specific pricing, trial periods, and refund policies will be disclosed at purchase. Subscriptions, if offered, will renew automatically per the platform's terms unless cancelled.

Refunds are handled by Apple or Google per their respective policies. Elevation Interactive LLC does not directly process or refund payments.

Intellectual Property

The App, its name, logo, and the original code that comprises it are the property of Elevation Interactive LLC. These Terms grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for non-commercial personal use.

Trademarks of third parties (including but not limited to Plex, Audiobookshelf, Apple, Google, CarPlay, and Android Auto) are the property of their respective owners and are referenced for descriptive purposes only.

Third-Party Services

The App interacts with third-party services that have their own terms and privacy policies, including Plex Media Server, Audiobookshelf, Sentry (for crash reporting), Apple iCloud, Google Android Auto Backup, the Apple App Store, and Google Play. Your use of those services is subject to their respective terms.

Apple App Store Terms

The iOS version of Awdio is distributed through the Apple App Store. Your use of the App on iOS is subject to the Apple Media Services Terms and Conditions, in addition to these Terms. Apple is not a party to these Terms and has no obligation to provide maintenance or support for the App. To the extent these Terms grant you usage rights, those rights are limited to a non-transferable license to use the App on Apple-branded devices you own or control, consistent with the Apple App Store Usage Rules.

Google Play Store Terms

The Android version of Awdio is distributed through Google Play. Your use of the App on Android is subject to the Google Play Terms of Service. Google is not a party to these Terms and has no obligation to provide maintenance or support for the App.

Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranty of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or compatible with every server configuration. To the maximum extent permitted by law, Elevation Interactive LLC disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Elevation Interactive LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the App, regardless of the legal theory of liability. Our aggregate liability for any claim arising out of or related to the App will not exceed the greater of (a) the amount you paid for the App or any premium feature in the twelve months preceding the claim, or (b) USD $25.

Termination

You may stop using the App at any time by uninstalling it. We may modify or discontinue the App, or any feature within it, at any time without notice. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will survive.

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by a new Effective Date at the top of this page. Continued use of the App after an update constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Disputes arising out of or related to these Terms will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable consumer-protection law in your jurisdiction.
